Welcome to ashleydorielle.com. These Terms of Service ("Terms") govern your access to and use of the website and coaching services provided by Ashley Dorielle ("Coach," "we," "us," or "our"). By accessing our website or purchasing coaching services, you agree to be bound by these Terms in their entirety.

Please read these Terms carefully before using our website or services. If you do not agree to these Terms, you must not use our website or engage our services.

1. Services Description

Ashley Dorielle provides 1:1 online fitness coaching services, which may include but are not limited to:

• Customized training programs
• Nutrition guidance and meal planning frameworks
• Posing coaching for bikini competitors
• Weekly check-ins and progress reviews
• Ongoing communication and support during the coaching period

All coaching services are delivered remotely through digital communication channels. Specific deliverables and scope are determined on a per-client basis following the application and acceptance process.

2. Health and Fitness Disclaimer

By engaging our services, you acknowledge and agree that:

• You should consult with a qualified healthcare provider before beginning any new exercise program, nutrition plan, or making changes to your existing health regimen.
• You should not disregard professional medical advice or delay seeking medical treatment because of any information received through our coaching services.
• Exercise and dietary changes carry inherent risks, including but not limited to physical injury, illness, and in rare cases, death. You participate in all physical activity at your own risk.
• Results vary from person to person. We do not guarantee any specific results, outcomes, or transformations. Testimonials and results shown on our website represent individual experiences and are not guarantees of future performance.
• You are solely responsible for ensuring that any exercises or dietary suggestions are appropriate for your individual health condition and fitness level.

3. Assumption of Risk

You expressly assume all risks associated with participating in any fitness program, exercise routine, or nutritional plan provided through our coaching services. You acknowledge that physical exercise involves inherent risks of injury, and you voluntarily assume those risks. You represent that you are physically fit and have no medical condition that would prevent your participation in exercise activities, or that you have obtained physician approval to participate.

You agree to immediately notify Ashley Dorielle of any injury, illness, or adverse reaction experienced during the coaching engagement. You agree to stop any activity that causes pain, dizziness, or discomfort and seek medical attention as needed.

4. Application and Acceptance

Access to 1:1 coaching is by application only. Submitting an application does not guarantee acceptance into the coaching program. Ashley Dorielle reserves the sole right to accept or decline any application for any reason. We only take on clients we are confident we can serve effectively.

Upon acceptance, you will receive details regarding coaching terms, start date, and payment information. The coaching relationship begins upon receipt of your first payment.

5. Payment Terms

By purchasing coaching services, you agree to the following payment terms:

• All fees are communicated prior to the start of coaching and must be agreed upon before services begin.
• Payments are processed through our designated third-party payment processor. You are responsible for providing accurate and current payment information.
• Coaching fees are due according to the payment schedule agreed upon at the time of enrollment (e.g., monthly, per coaching block).
• Late or failed payments may result in a pause or termination of coaching services.

6. Refund Policy

Due to the personalized nature of 1:1 coaching, all sales are final once coaching services have commenced. Refund requests for undelivered services will be reviewed on a case-by-case basis at the sole discretion of Ashley Dorielle.

If you wish to discontinue coaching, you must provide written notice. No refunds will be issued for partially completed coaching periods. Any outstanding balance remains due regardless of early termination.

7. Intellectual Property

All coaching programs, training plans, nutrition guides, educational content, and materials provided through our services are the proprietary intellectual property of Ashley Dorielle. These materials are provided for your personal use only during the coaching engagement.

You agree not to:

• Copy, reproduce, distribute, or share coaching materials with any third party.
• Resell, sublicense, or commercially exploit any coaching content or programs.
• Use coaching materials to create derivative works or competing services.
• Record, screenshot, or capture coaching calls or communications for distribution without prior written consent.

Violation of these intellectual property provisions may result in immediate termination of coaching services without refund and may subject you to legal action.

8. Client Responsibilities

As a coaching client, you agree to:

• Provide accurate and complete information in your application and throughout the coaching relationship, including honest disclosure of relevant medical conditions, injuries, and medications.
• Complete weekly check-ins and communicate consistently as outlined in your coaching agreement.
• Follow your coaching program in good faith and communicate promptly if you have concerns, questions, or experience any issues.
• Maintain respectful and professional communication at all times.
• Not hold Ashley Dorielle responsible for outcomes resulting from failure to follow the prescribed program or from modifying the program without consultation.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Ashley Dorielle, including any employees, contractors, agents, or affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business, or loss of data, arising out of or related to your use of our website or coaching services.

In no event shall our total liability to you for all claims arising from or related to the services exceed the total amount paid by you for coaching services in the three (3) months preceding the event giving rise to the claim.

This limitation of liability applies regardless of the legal theory upon which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to defend, indemnify, and hold harmless Ashley Dorielle, including any employees, contractors, agents, and affiliates, from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the website or coaching services.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Any injury or harm you sustain during participation in exercise or nutritional activities related to the coaching services.
• Any misrepresentation of your health status, fitness level, or medical conditions.

11. Termination

Either party may terminate the coaching relationship with written notice. Ashley Dorielle reserves the right to terminate coaching services immediately and without refund if:

• You violate any provision of these Terms.
• You engage in abusive, disrespectful, or harassing behavior.
• You share or distribute proprietary coaching materials.
• Payments are not received according to the agreed schedule after reasonable notice.

Upon termination, your access to coaching materials and communication channels will be discontinued. Any provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property, limitation of liability, indemnification, and governing law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.

13. Dispute Resolution

Before initiating any legal action, you agree to first attempt to resolve any dispute informally by contacting us at hello@ashleydorielle.com. We will attempt to resolve the dispute through good-faith negotiation within 30 days. If the dispute cannot be resolved informally, either party may pursue legal remedies as outlined in the Governing Law section above.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated effective date. Your continued use of our website or services following any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

For active coaching clients, material changes to these Terms will be communicated via email or through our regular communication channels.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and any coaching-specific agreements provided upon enrollment, constitute the entire agreement between you and Ashley Dorielle regarding the use of our website and services. These Terms supersede any prior agreements or communications.
